Will of Allin HOGGARTH (made 24 June 1938) 1858-1940

This is the last Will of me ALLIN HOGGARTH of Beulah House Hinderwell in the county of York Retired Farmer which I make this twenty fourth day of June One thousand nine hundred and thirty eight
1.  I revoke all wills and testamentary dispositions at any time heretofore made by me
2.  I appoint my sons George Hoggarth and Harry Hoggarth (hereinafter called "my Trustees") to be the Executors and Trustees of this my Will
3.  I give to my sons William John Hoggarth  Allan Hoggarth  Robert Stephenson Hoggarth and my daughter Hannah Stevenson a legacy of five pounds each free of duty
4.  I devise all my real estate and bequeath the residue of my personal estate unto my Trustees Upon Trust to sell call in and convert the same into money (with power to postpone such sale calling in and conversion for so long as they shall in their absolute discretion think fit without being responsible for any consequent loss) and after payment thereout of my debts and funeral and testamentary expenses my Trustees shall stand possessed of the residue thereof In trust for my sons the said George Hoggarth the said Harry Hoggarth  Joseph Hoggarth  Charles Hoggarth and my daughter Beulah Allin Hoggarth in equal shares absolutely Provided that if any of them the said George Hoggarth  Harry Hoggarth  Joseph Hoggarth  Charles Hoggarth or Beulah Allin Hoggarth shall die in my lifetime leaving issue him or her surviving such issue shall take and if more than one in equal shares the share which his her or their parent would have taken if living at my death

BE IT KNOWN that Allin Hoggarth of Beulah House Hinderwell in the County of York

died there on the 25th day of June 1940

AND BE IT FURTHER KNOWN that at the date hereunder written the last Will and Testament (a copy whereof is hereunto annexed) of the said deceased was proved and registered in the Principal Probate Registry of His Majesty’s High Court of Justice and that Administration of all the Estate which by law devolves to and vests in the personal representative of the said deceased was granted by the aforesaid Courts to
George Hoggarth of Aislaby Sleights in the said county Gardener and Harry Hoggarth of Golden Grove Ruswarp near Whitby in the said county Council Employee sons of deceased the executors named in the said will
And it is hereby certified that an Affidavit for Inland Revenue has been delivered wherein it is shown that the gross value of the said Estate in Great Britain (exclusive of what the said deceased may have been possessed of or entitled to as a Trustee and not beneficially) amounts to £1121-2-1
and that the net value of the personal estate amounts to £423-12-1
And it is further certified that it appears by Receipt signed by an Inland Revenue Officer on the said Affidavit that £33-1-4 on account of Estate Duty and interest on such duty has been paid.

BRYAN'S NOTES:

Allin Hoggarth, of Hinderwell, was the Great Grandad of Bryan HOGGARTH and others.  (Photos are available on Bryan's website - see 'Recommended Links').

Allin was the son of Lawrence John HOGGARTH and Elizabeth ALLIN, born 4th March 1858 in Newholm near Whitby.  His first wife, married 8th August 1881, was Mary STEPHENSON and they lived at Heulah Farm near Dunsley.  Allin's second wife, married 9th November 1895, was Eliza Jane BOWERS from whom there were more children.  Among the children of Allin were: Stephenson from whence Ivan HOGGARTH, Mary YOUNG and Ian KEELER Allin from whence Dave HOGGARTH in Carstairs, Doug HOGGARTH in South Africa and Bryan HOGGARTH.
